General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale (GTCS) apply to any order placed by a consumer (an individual purchasing for purposes unrelated to their professional activity) on the website www.superista.fr, operated by Alison Tran (Superista), 16B Avenue de la Marne, 59290 Wasquehal, France — SIRET 984 440 420 00011.
Article 1 — Purpose and Scope
These GTCS govern the sale of Superista products (superfood drink powders) through the website to consumers. Placing an order constitutes full and unconditional acceptance of these GTCS.
Article 2 — Products
Superista sells superfood drink powders (Golden, Matcha, Chai, Pink, Ube and Hojicha). The essential characteristics of each product, including ingredients, allergens and organic certification where applicable, are stated on the relevant product page.
Article 3 — Prices
Prices are stated in euros and include all applicable taxes (TTC), excluding delivery charges, which are specified before the order is finally confirmed.
Article 4 — Orders
An order is confirmed once payment has been successfully processed. An order summary will be sent to the customer by email.
Superista reserves the right to cancel or refuse any order in the event of a previous dispute, an out-of-stock product or a breach of these GTCS.
Article 5 — Payment
Payment is made online at the time the order is placed, using the payment methods available on the website, including credit card and/or other methods offered through Shopify Payments.
Article 6 — Delivery
Products are delivered to the address provided when the order is placed, within mainland France and Belgium.
Delivery times and charges are displayed before the order is confirmed and are detailed in our Shipping Policy.
Article 7 — Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, consumers have a period of 14 days from receipt of the product to exercise their right of withdrawal without having to provide a reason.
To exercise this right, the customer must notify Superista of their decision by emailing alison@superista.fr before the expiry of the withdrawal period.
Products must be returned unopened and in their original condition, for hygiene reasons applicable to packaged food products. Return costs are borne by the customer unless otherwise specified.
In accordance with Article L.221-24 of the French Consumer Code, refunds will be made without undue delay and no later than 14 days from the date on which Superista is informed of the customer's decision to exercise their right of withdrawal.

Article 8 — Legal Guarantees
Every product is automatically covered, at no additional cost, by:
- the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code), for a period of 2 years from delivery of the goods;
- the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Article 9 — Consumer Mediation
In accordance with Article L.612-1 of the French Consumer Code, in the event of a dispute that cannot be resolved directly with Superista, the consumer may use the CM2C consumer mediation service free of charge, to which we are registered:

Article 10 — Applicable Law and Jurisdiction
These GTCS are governed by French law.
In the event of a dispute, and in accordance with applicable regulations, the consumer may bring proceedings before either a court with territorial jurisdiction under the French Code of Civil Procedure or the court of the place where they resided at the time the contract was concluded.
